Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Zaurah Technologies ("Company", "we", "us", or "our"), the operator of cv.zaurah.com (the "Service" or "Platform").

By accessing or using the Service — including creating an account, browsing as a guest, using our API, or accessing any content — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service after any modifications to these Terms constitutes acceptance of the modified Terms.

2. Eligibility

To use the Service, you must:

• Be at least 16 years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher);
• Have the legal capacity to enter into binding contracts;
• Not be prohibited from accessing the Service under applicable laws;
• Not have been previously banned or suspended from the Platform.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" will refer to that organization.

3. Account Registration

3.1 Account Creation

To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your login credentials;
• All activities that occur under your account;
• Immediately notifying us at security@zaurah.com of any unauthorized access or security breach.

We recommend enabling strong passwords (minimum 8 characters with letters and numbers) and will never ask for your password via email or support channels.

3.3 One Account Per Person

Each individual may maintain only one personal account. Creating multiple accounts to circumvent limitations, exploit trial offers, or evade suspension is prohibited and grounds for immediate termination.

4. Subscriptions & Billing

4.1 Plans

The Service offers multiple subscription tiers, including a free tier ("Free"), and paid tiers ("Premium", "Professional", or as otherwise named). Features, template access, export limits, and AI usage quotas vary by plan and are detailed on our Pricing page.

4.2 Billing Cycles

Paid subscriptions are billed either monthly or annually, as selected at the time of purchase. Your subscription will automatically renew at the end of each billing cycle unless canceled before the renewal date.

4.3 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. We do not store your full credit card number on our servers. By providing payment information, you authorize us to charge the applicable subscription fee.

4.4 Price Changes

We may change subscription prices with at least 30 days' prior notice via email. Price changes will take effect at the start of your next billing cycle following the notice period. If you do not agree with the new pricing, you may cancel before the change takes effect.

4.5 Refunds

Monthly subscriptions are non-refundable after the billing date. Annual subscriptions may be refunded within 14 days of the initial purchase or renewal if no premium features have been materially used during that period. To request a refund, contact billing@zaurah.com.

4.6 Failed Payments

If a payment fails, we will attempt to charge your payment method up to three times over a 10-day period. During this time, your premium features may be restricted. After the grace period, your account will revert to the Free plan, but your data will be retained.

5. Free Trial

New users may be eligible for a 14-day free trial of Premium features. The trial:

• Is limited to one trial per individual, regardless of the number of accounts created;
• Provides full access to Premium features for the trial duration;
• Does not require a credit card to start;
• Automatically reverts to the Free plan at the end of the trial period;
• May be modified, extended, or discontinued at our discretion.

CVs created with Premium templates during the trial will remain accessible in read-only mode after the trial ends. You may upgrade at any time to regain edit access.

6. Acceptable Use

You agree not to use the Service to:

• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Submit false, misleading, or fraudulent information in CVs intended to deceive employers;
• Upload or distribute viruses, malware, or any harmful code;
• Scrape, crawl, or automate access to the Service without prior written authorization;
• Reverse-engineer, decompile, or disassemble any part of the Service;
• Use the Service for bulk or spam purposes (e.g., generating hundreds of CVs for third parties without their consent);
• Violate any applicable laws, regulations, or third-party rights;
• Attempt to bypass any security measures, rate limits, or access controls;
• Share, resell, or redistribute your account access or subscription benefits to unauthorized third parties;
• Upload content that is defamatory, obscene, hateful, or that infringes intellectual property rights.

We reserve the right to investigate violations and take appropriate action, including suspending or terminating accounts, reporting conduct to law enforcement, and pursuing legal remedies.

7. Content Ownership

7.1 Your Content

You retain all ownership rights to the personal information, text, work history, education details, and other content you input into the Service ("Your Content"). We claim no intellectual property rights over Your Content.

7.2 License to Us

By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

• Store, process, and render Your Content for the purpose of providing the Service;
• Generate PDF, DOCX, and other output formats from Your Content;
• Create encrypted backups for disaster recovery purposes;
• Use anonymized, aggregated data (with all personally identifiable information removed) to improve the Service.

This license terminates when you delete Your Content or your account, subject to our data retention policies outlined in our Privacy Policy.

7.3 Our Content

All templates, designs, UI elements, graphics, logos, icons, algorithms, AI models, and software code comprising the Service are the exclusive property of Zaurah Technologies or its licensors. You may not copy, modify, distribute, or create derivative works from our content without express written permission.

8. AI-Generated Content

8.1 Nature of AI Assistance

The Service provides AI-powered features including, but not limited to, content suggestions, bullet point generation, summary writing, skill recommendations, and ATS optimization scoring. These features use third-party AI models (such as OpenAI, Anthropic Claude, or similar providers) to generate suggestions.

8.2 Your Responsibility

AI-generated suggestions are provided as a starting point. You are solely responsible for:

• Reviewing all AI-generated content for accuracy, truthfulness, and appropriateness;
• Ensuring that the final CV content truthfully represents your qualifications, experience, and credentials;
• Editing, modifying, or rejecting AI suggestions as you see fit;
• Any consequences arising from the use of AI-generated content in your CV.

8.3 No Guarantee

We do not guarantee that AI-generated content will be error-free, factually accurate, free from bias, or suitable for any particular purpose. AI suggestions may occasionally produce inaccurate, incomplete, or inappropriate content.

8.4 Data Processing

When you use AI features, relevant portions of Your Content may be transmitted to third-party AI providers for processing. We use API-level integrations where provider terms typically prohibit training on customer data. See our Privacy Policy for details on third-party data processing.

9. Templates & Designs

9.1 Template License

Paid subscribers receive a non-exclusive, non-transferable license to use all available templates for personal CV creation and distribution to potential employers, recruiters, and professional contacts. This license is valid for the duration of your active subscription.

9.2 Restrictions

You may not:

• Redistribute, resell, or sublicense our templates;
• Use templates to create a competing CV builder service;
• Extract, copy, or replicate template designs, CSS, or HTML source code;
• Remove or modify any attribution, watermarks, or branding from Free-tier exports.

9.3 Free Tier Limitations

CVs generated on the Free tier may include a subtle "Built with cv.zaurah.com" watermark on exported PDFs. Upgrading to a paid plan removes this watermark.

10. Service Availability

10.1 Uptime

We strive to maintain 99.9% uptime for the Service. However, the Service may be temporarily unavailable due to scheduled maintenance (typically during low-traffic hours with advance notice), emergency maintenance, force majeure events, or circumstances beyond our reasonable control.

10.2 Data Backups

We perform daily encrypted backups of all user data. In the event of data loss, we will make commercially reasonable efforts to restore data from the most recent backup. However, we cannot guarantee that all data can be recovered in every scenario.

10.3 Service Modifications

We reserve the right to modify, update, or discontinue any feature of the Service. For material changes that reduce functionality available to paid subscribers, we will provide at least 30 days' notice and, where appropriate, offer pro-rated refunds or extended access.

11. Third-Party Services

The Service integrates with or relies on third-party services, including:

• Stripe — Payment processing
• AI Providers (OpenAI, Anthropic) — Content generation
• Cloud Infrastructure — Data hosting and storage
• Email Services — Transactional and verification emails
• Analytics — Anonymized usage statistics

Your use of these third-party services is governed by their respective terms. We are not responsible for the practices, policies, or content of third-party services. Links to third-party websites do not constitute endorsement.

12. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key commitments:

• We never sell your personal data to third parties;
• Your CV content is encrypted at rest and in transit;
• You may export or delete your data at any time;
• We comply with GDPR and applicable data protection regulations.

13. Termination

13.1 By You

You may cancel your subscription and/or delete your account at any time through your account settings. Upon cancellation:

• Your subscription remains active until the end of the current billing period;
• You will not be charged for subsequent billing periods;
• Your account data will be retained for 30 days for recovery purposes, then permanently deleted.

13.2 By Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our Acceptable Use policy;
• Your account is involved in fraudulent activity;
• You fail to pay subscription fees after the grace period;
• Required by law or court order;
• The Service is being discontinued (with reasonable notice).

13.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Content Ownership, Disclaimers, Limitation of Liability, and Governing Law) will survive.

14. Disclaimers

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Warranties that the Service will be uninterrupted, timely, secure, or error-free;
• Warranties regarding the accuracy or reliability of AI-generated content;
• Any warranty that the Service will meet your specific requirements or expectations.

We are not responsible for employment outcomes. While our tools are designed to help you create professional CVs, we cannot and do not guarantee that using the Service will result in job interviews, offers, or employment. Hiring decisions are made by employers based on many factors beyond your CV.

15. Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, business opportunities, or goodwill;
• Our total aggregate liability for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD;
• These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Zaurah Technologies, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the Service;
• Your violation of these Terms;
• Your violation of any third-party rights;
• Content you submit, including false or misleading information in CVs;
• Your violation of any applicable laws or regulations.

17. Dispute Resolution

17.1 Informal Resolution

Before filing any formal legal action, you agree to first attempt to resolve disputes informally by contacting us at legal@zaurah.com. We will attempt to resolve the dispute within 30 days.

17.2 Arbitration

If informal resolution fails, any dispute arising from these Terms shall be resolved through binding arbitration administered under the rules of an internationally recognized arbitration body, conducted in English. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.

17.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding.

18. Modifications to Terms

We may revise these Terms from time to time. When we make material changes:

• We will update the "Effective" date at the top of this page;
• We will notify registered users via email at least 15 days before the changes take effect;
• We may display a prominent notice within the Service.

Your continued use of the Service after the effective date of revised Terms constitutes acceptance. If you disagree with any changes, you should discontinue use and cancel your account before the new terms take effect.

19. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Zaurah Technologies is registered, without regard to conflict of law principles. Any legal proceedings that cannot be resolved through arbitration shall be brought exclusively in the courts of that jurisdiction.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions will continue in full force and effect.

The failure of either party to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
